183 Day rule for Tax exemption

Hi! I want to make sure I'm under the 183day rule so I'm.not double taxed in the US and Brazil. It looked a little complicated and I talked to some lawyers and don't know if I should pay them for help or not. Basically if I just count my first arrival in Brazil then 365 days after that is a year correct? Even if it spans 2 calendar years. So as long as I'm not in the country more than 183days in that period I'm fine? If my new 'year' starts but I'm.still in the country, that is also fine right, bc it's been over 365 days?

I think you should be fine. 183 days in any 365 day frame, as I read : in any given moment if you look back and presented at least 183 days in Brazil, you will be tax residence from then. so your first 183 days are tax-exempt and you would have to consider rest of them.

and if you have the permanent residency you would be taxed on international incomes no matter you were in Brazil or not.


P.S: I am not a tax expert, its just my understandings from reading the tax law.

As I mentioned in another post - you will be here as a tourist, and therefore cannot work legally, so will not be liable for any tax in Brazil. Brazil will also not tax you on your income in the US.
