if you are locally hired ,after you finish your contract you can transfer to another company after contract even they give you sign undertaking ,give me some info about this please to know what to do?Thanks

As you know, Qiwa is just only a portal, to facilitate local transfer after you (employee), current (present) employer company, and new employer agreed to all terms and conditions.

Bear in mind that local transfer of sponsorship is not a legal right of foreign expat. It is subject to the discretion of the sponsor (employer) and approval of the official authority i.e. MOL and MOI. The right approach is to talk politely to your employer to allow you to find another job and transfer your visa to new employer.

Having said that, a local transfer of sponsorship can be done WITHOUT current (present) company employer approval, and the undertaking you've signed prohibiting you to seek new employer will be quashed (void) provided below conditions are met:

1) No valid employment contract between the employee and current (present) employer
2) Employee Iqama is expired
3) Not receiving salary for more than 60 days

Definitely yes. Regardless the nitaqat red category of your company, you must obtain prior approval from your current employer.

In your case, yes, it will go to your current employer, either to accept or reject the transfer request via Qiwa platform.

Yes, you will.
If the company is in RED then not matter what is the situation, the transfer will be done automatically.

Hi,

I came free visa and kafil is red can't make Iqama. Its reached 4 months and i get my iqama number only through online but i don't have card but its expiry. In my arrival i don't have iqama. Now i got job offer and that company try to trasnfer through my iqama number they said " there is no details in ministry of labour" of my Iqama. And also i activate my absher account and have qiwa account. But my new employer request to try to transfer through my Iqama number only. They said no details or registeration in ministry of labour.

Please help how to solve
Is there any solution to transfer?

@Arsal7 ohh that company can't visit jawazat office. Because they job offer only and if transfer they can do. Or Do you have any other solution online transfer. Is it possible trasnfer qiwa or my border number?

hello there, I want to know some information in 2019 Dec 1 I transfer my sponsorship to a new company who is mention in my job offer letter that my contract period will be 2years so I have already finished my contract as per the job offer letter and also I an working extra 5 months more. so as per the mention I have already finished my contract now I want to transfer my sponsorship I asked my company they said they will not give me a transfer if I don't want to work they will give me an exit. also, I am hired as a fiber optic technician now the company doesn't have that work, and the work they have I cant do. when I joined this company I have my iqama remaining 9 months I know that doesn't matter as per my knowledge my contract is finished so I can take transfer sponsorship in a legal way ... now I want to know my company already refuse to give sponsorship transfer so I am thinking that I will go labor court and tell them what happened to me for that what is the consequences that I will face and how can I make a case on my company. I only have the job offer letter copy with me can someone assist me in that case. I need a legal advisor or lawyer to fix the issue for me

 You should consult to a lawyer and put a case against the company. 
And you will get the transfer.

Only 3 conditions in which one can get the transfer without kafeel approval.

1: Iqama is expired more than 3 days.

2: Company niqatat status in RED.

3: One did get the salary for 3 months straight.

My coffee shop has 2 owner (partners).couple of month ago my sponsor ( his name is ali) take my sponsorship and made a contract for 1 year. Which is valid till 13th January 2023. After waiting 3month he did not issued my iqama. So that i transferred my sponsorship  to another owner ( his name is saidul). He did not made any contract. The new sponsor (saidul) made my iqama for 3 month. 1 month ago he leave this shop.  About 1 week ago iqama has been expired. After couple of request saidul (new sponsor) renewed it for 3 months again. Notice that they did not gave me any of my iqama card. I requested them for my iqama card may be a thousands time. The old sponsor is threatening me to work as they want .

Now the situation is with whom I have contract he is not my sponsor and with my sponsor I did not have any contract.

Is there any way to cancel my previouse contract? (Mantioned that I did not signatured  or gave fingerprint in any paper. Contract is just on the qiwa platform and as I was not able to accept the contract of new sponsor the contract request expired. Here I saw my contract with previoussponsor. )

I therefore pray and hope that you will be kind enough to tell me the way to cancel the previouse contract or any way to solve it.

If Saidul is your sponsor in Absher/Tawakalna.
Then, old sponsor can't do anything.
If your absher is showing ali, you have to obey him.
That's it.

I have come on a company visa and I signed the job offer on Feb 22 but officially joined on 24 May 22, but as of now, I haven't signed any official contract from company and no contract on GOSI and Qiwa until now.


as per 8 conditions to transfer without concern of current employer, there is no official contract on GOSI or Qiwa within 3 months from the entry into Saudi.


Can I get a transfer without notifying the current employer?

I have been working in current job through local transfer and worked 6 years. Now they terminated my contract bcz of low income reasons. They are saying no transfer will be given. What is the next thing for me  to do? I don't want to go exit. I have job offers.

Dear all

Plz help me one of freind went saudi arabia on 9 Sept 2022 on free visa .

After few days he gave interview in reputed company. 6 feb 2023 he got offer letter via email.but the problem is that he is working with one contractor and he sing the contract thorough the qiwa platform. But now he want another transfer from his current employer .he called him and convinced him to give the transfer but i don't know what happened with them now they r saying wait u have time . In finally they r not giving him good response. And he already sing the offer letter with another company and they asked him to send the documents.


But question is that if get the transfer request from qiwa with new contract and my current employer not accept the request.the new employer can file suit against him or they can  calim for damage.

@Arsal7 Assalamualikum I need a suggestion from you brother....My contact ends on 2nd August 2023 but currently i have a job offer from another company from Riyadh (I am in jubail) will my present company will transfer me? If not then as per Qiwa contract i have to inform them 2 months prior to end of contact. I will do that, even then will they trouble in giving the transfer? I want to ask about my issue and give me advice. I already accept transfer from qiwa and i dont need approval of current emoloyer my transfer status is "pending for notice period of completion" either they accept or not after 90 days it will automatic transfer now only 77days balance. My employer issue me final exit. One of my friend told me exit visa will expire in 60 days. I want to know what happen if exit visa expire is it considered cancel?. Once my transfer finish is my new employer can cancel? Because my absher will be in the new employer. Thank you.

Your friend understanding is correct because once your current/present old employer opted to issue you a “final exit only visaâ€, this will send signal information to Qiwa that your current/present old employer does not want your services anymore. In this instance, the 90 days notice period duration will reduce to 60 days or less, and your will automatically transfer to new employer/ sponsor.

In 2018, I was transferred from my kafeel to a contractor company to provide services to Company A. Company A paid for my transfer since they were the ones who requested it. Now, Company A is planning to transfer me to another contractor company. However, my current company says they can’t transfer me to a competitor. Is this correct? I’m just asking

It must be their internal policy.  No such barrier from immigration.

my contract finished in qiwa platform and I also put resignation on  time means three months before from the end of the contract now I have no contract in qiwa or written but the issue the company don't give me final exit. any legal way available for taking final exit.

Because me I'm local hired and i have 2 yrs contract and i wanted to transfer because i have a good offer but im only 5months do i have the right to terminate my contract? But my employer dont want to accept the resignation even though i render already 1 month notice period accdg to their policy.
