Termination without employee consent

Dear Members,

As part of the company internal process, company force me to resign from my position, I am working in Accounts department and company decided to move all the accounting Job to out side KSA( INDIA) because of this reason they are terminating 2 people from accounts dept. I have some doubt on End of service,can someone clarify the below
My contract is indeminity and my joing date on Jan 2011.

1) Whether outsource activities are permited in SA
2) Due to this outsource activity whether company can terminate employees?
3) What type of compensation i can get from company? how will be the EOSP calculation?
4) Company has not yet issued any lettter to me, verbally HR director has called and informed me that Nov 30th will be my working day.
5) I have leave balance and compnay is forcing me to take all the leave balance because they will not pay leave encashment , is this as per our saudi labour law?
6) I have taken HRA and LTA advance from compnay, whether campany can deduct this from my end of service?
7) What is the labour law stats about deduction in the case of termination.
8) If i go to labour court what type of support i will get.
9) If i am not signing the final paper what action compnay can take?

Please help me to get clear answer on the above issues.

Are they asking you to resign or they are terminating. Some companies push employees to resign as it helps them save some money from end of service benefits.

I did't resign.. they are terminating from service. I have searched many web sites.. labour sites but i could't able to find the answer for the above my doubts.. Can you please help to get correct answer or please let me know if any consultancy is avaialbe to clarify aove my doubts.

bottom line, nothing you can do. although I see you're indian u should ask them to move you back to india where they are relocating anyway.

just pass the time...don't resign... ask them to terminate you...that too in writing...keep copy of this termination letter with you in case u need to visit labor office. dont apply for vacation. they need to pay that

Based on what I know of the labor law, they can't push you to resign. In order to terminate you, they have to issue you a termination letter with 30 paid days notice; or at least the pay of 30 days. Of course, he is the employer and can terminate any employees as he likes but legal formalities have to be fulfilled.

As the first thing, check out your contract. All of this must be written in there. You can take a copy and open discussions with the HR Manager.

If you are being terminated, do the following:

1.) Keep the copy in writing that you are being terminated.
2.) You need to be paid a salary of a minimum of 4 months OR till the end of contract, whichever is later.
3.) You need to collect all  your dues before leaving for exit. (Incase, you do not get a transfer).
4.) The employer will pay you for one way fare to your home city.

Depending on your terms and the prevailing conditions, you can ask for a release and look for work outside.
