Hi im a permanent resident in cebu. 



I am divorced from my filipina wife but for filipo law we are still married


cause theres no annulment.



Soon its time again to pay the annual report.  Every year it is the same hassle.


I ask where i can pay and I always end up with a fat officer who tries to extort money from me


saying im in violation of several filipino laws (residence).  He even said that im registered as divorced


from my wife.  Instead of the usual 310 peso i end up paying 4000 peso to get the annual report done.



How can i avoid this?



Can i pay this annual report through my bank account?

Philippines law recognize divorce made abroad, no need for annulment

yeah i read that also but it is easier said than done.  You still need to go to court for this.  Just a certificate of divorce is not enough and its hard to find an honest attorney to get this done

Legally, if you divorce from your wife you lose your visa 13A and you are downgraded to a tourist visa. Second you lose also your ACR-I card. And I suppose you changed your address but you kept your old address on your ACR card. Is your ACR card still valid (validity 5 years) ?

So if the immigration officer was following the law he would have downgraded your status to tourist. I have some friends who divorced from their Filipina wives and who became suddenly tourists in the PH after several decades being permanent residents in the PH. But their divorce were recognized by the court of Manila. So I suppose that because your divorce is not recognized yet you can still be a permanent resident.

I read on another forum that once you get a permanent yellow permanent resident card for 5 years you can not lose your permanent residency whatever your marriage status.

No everything is linked to your marital status and you automatically lose your permanent visa if you are not anymore married with your wife. You can have again your 13A if you get married again with a Filipina. 13A is for a foreign spouse of a Filipino

Well, if you've been here for 10 years it's possible to apply for citizenship. But that might bring other consequences.

I'm seriously thinking about doing so, to avoid the enormity of governmental chaos in the UK!

For citizenship : if you ask to be Filipino you will lose your UK citizenship. Except if one of your parents is Filipino

You should feel blessed the Immigration Officer is only charging you 4,000 Peso to extend your 13A Visa.   A visitor on a Tourist Visa can pay 4,000 Peso for a two month extension.  Your foreign divorce nullifies your status for a 13A Visa.  For years Philippine Immigration have ignored the law regarding the marital status and living arrangements of foreigners married to Filipina.  Currently the Law states you must downgrade your status when you no longer live together as man and wife.  The current Commissioner Jamie H. Morente is a 'by the book Commissioner'.  In time the Commissioner will likely ask for proof you currently qualify for a 13A Visa.  I guess that could mean your Filipina wife will also be required to testify during the annual census you live together as man and wife.  Feel lucky the Immigration Officer did not change your Visa status from 13A to tourist.

Lose UK citizenship does not the UK allow dual? The Philippines allows dual now so it shouldnt be a problem.

The Philippines allow dual citizenship for a former Filipino who lost his Filippines citizenship and wants to have it back. Allowed also for children of mix parents. But not allowed  for a foreigner who has no "filipino blood"

I  got my divorce in Australia, and it is recognized by the Filipino government. If your X wants to remarry, then it's up to her to lodge the divorce papers with her government. FYI the Filipino Court do grant annulment, my partner just got hers granted in the Cebu Court. Cost a fortune!

You must reside with your wife at the same address to have your 13A in force ,married or not , you are a tourist unless you get another visa

Has nothing to do with his divorce it is legal, it is the wife that needs to go into court so that she can remarry

The fat guy still at immigration cebu, carma cought up with him, skinnier and voice changed. On the way out. So I'm lucky, only paying 2500-3000 pesos,still receipt 310pesos for reporting (8 years). Can't register, because they didn't put correct details, like Cebu/province and barangay missing. That's they trick, lately I needed a new ACR I card. Price 12000 pesos, 2850 on receipt. Guess they all share the extra, not just the fat guy I'm glad you have the guts to bring this shit up, so did I. My wife worried. My first I  card cost me 32000 pesos. Just imagine national security with officials like this. anyone can get in, terrorists, scammers, many scammers get deported, But HOW THEY GOT IN THE FIRST PLACE. Cheers guys.

They do everything. And they do it efficiently. I was there in October. Added a 6 month visa and renewal of ARC-1 card. I was out of there in 20 mins max.
