Taking freelance work for Other Companies in Malaysia?

billytanuwijaya

Hi all,

I'm an Íæż½ã½ã and currently holding a work permit for a company in Malaysia. Would it be okay for me to take freelance work from other Malaysian companies? Would there be a work permit issue? Assuming my company has no objection to me taking this freelance work from other companies.

Your question is complex because many expats come here on the assumption that there is such a thing as a General Permit to Work but there is no such thing. Your permit is tied to the first company that hired you and Ive never heard of anyone having multiple permits to work at multiple companies. That said, if I had a chance to make extra money and its paid in cash and no records, I might do it but Im not suggesting anyone break the laws. Then too, i'll assume that a company wants records so that it can enjoy tax deductions and also doesnt want to break the laws so finding such an employer might be difficult. So, in a specific case like yours, if the subsequent or second employer was just some guy and not a company, I would personally do it but thats just me and knowing im taking some risks.

Hello,

It is stipu;ated in your Employment Pass that you are to work in a certain mentioned company and in a certain position. You are not permitted to do anything else for a different company in a different capacity.

Clearly defying Immigration Regulations

@Peter Chong thanks Peter for the clarification.

Do you know if I can just ask them to send the money to my bank at my home country, would it be considered as defying the employment pass? The freelance work would still be in Malaysia.

You can't do two jobs in Malaysia this is what stated in employment pass but if work is outside Malaysia I don't think of any issue other than if you transfer large amount in Malaysian banks they will ask about it. You can use online wallets with debit cards like WISE to spend in Malaysia

@ExpShuw

thanks for the reply, noted for this, means I cannot take this freelance work opportunity.

will consider this again once I get my Resident Talent Pass, thanks again for all the info here!
