Divorce procedures in Mauritius

Kevin_R

Good morning all,

I would like to request some information for a friend (married under the regime of communauté de biens / legal community of goods and property) on the divorce procedures in Mauritius:

  1. Should she retain the services of a lawyer or a notary? Are there specialised divorce lawyers in Mauritius? Any recommendations (via message) would be most appreciated.
  2. How long does it take on average for a divorce to be settled in Mauritius?
  3. Which criteria determine which parent will get the custody of children?
  4. How are assets shared? In the case that one spouse has contributed only partly (not half-half) to construction, is property divided equally between both spouses?

Cheers.

K.

Hello Kevin,

Divorce procedures can be complex, especially when it involves legal regimes such as communauté de biens etc... If your friend is in Mauritius, it is best to have an initial consultation with a lawyer to clearly understand her rights and options based on her specific case.

Feel free to browse our Mauritius business directory to find professionals offering legal services.

All the best,

Cheryl
